The New York Appraisal Clause Playbook
For a New York total-loss claim, the appraisal clause converts a lopsided desk negotiation into a structured, contractually-binding ACV determination. Most standard New York auto policies include a binding appraisal clause — check the Loss Settlement or Conditions section of your policy. Reference: 11 NYCRR 216.7. New York's regulator (1-800-342-3736) treats unilateral carrier refusal to appraise as a reportable practice under 11 NYCRR 216.7 (Unfair Claims Settlement Practices).. Whether the loss happened in New York or out of state, the policy controls.
Where to send the demand
In New York, the cleanest routing is certified mail to the declarations-page claims address with the subject line "Demand for Appraisal — 11 NYCRR 216.7 (Unfair Claims Settlement Practices).." Email a copy to the adjuster the same day. The New York DOI complaint line is 1-800-342-3736; you only need it if the carrier ignores the demand past two weeks.
Umpire selection in New York
Umpire selection in New York is typically a phone call between the two appraisers from a short list of mutually-trusted names. Court appointment is rare and reserved for cases where one side refuses to cooperate. New York-based umpires charge $400–$700 for a single-vehicle ACV decision; outside-metro umpires sometimes bill mileage on top.
Timeline expectations
Most New York files run 39 days end-to-end: 1–3 days for the carrier to acknowledge, 7–10 days to name their appraiser, 5–10 days for both appraisers to exchange numbers, 5–14 days for either an agreement or umpire selection, and a settlement check within 30 days of the signed award. New York-area files trend a few days faster because most independent appraisers are local.
Who pays what
In New York, the cost stack is: your appraiser ($300–$600), the carrier's appraiser (theirs, not yours), and the umpire ($400–$900 split 50/50, only if the two appraisers cannot agree). The total out-of-pocket on most New York files is the appraiser's bill alone.
Three tactics that move New York carriers fastest
- Request a copy of the actual comparable vehicle window stickers cited in the valuation, not just the line items. Most reports cite trims and options that the comps do not actually have.
- Document the request: send the demand by certified mail, retain the green card, and email a PDF copy to the adjuster the same day. Carriers regularly claim verbal invocations never happened.
- Pull your own comp set before the demand goes out. Knowing local dealer asking prices means you can immediately push back on the carrier's first appraiser position.
Three pitfalls that void or weaken the clause in New York
- Failing to ask for the comp window stickers. Reports cite trims; comps frequently do not match.
- Missing the policy's appraisal-demand deadline. Most carriers do not impose one, but a few do — read the policy form before you wait.
- Walking away because the adjuster says "that's not how we do it." Adjusters say that on roughly half of all first invocations; the policy still controls.
