Terms of Service & Refund Policy

1. Who we are
AutoACV ("AutoACV," "we," "us") is an independent appraisal service. We are not an insurance company, law firm, claims adjuster, or agent of any insurance carrier. By purchasing a service from us, you agree to these Terms.
2. The service you are buying
You are purchasing a professional appraisal report — a digital deliverable produced by a licensed independent auto appraiser. The deliverable is a USPAP-compliant written report (PDF) covering your vehicle, comparable market research, and a rebuttal of the insurer's valuation. Standard turnaround is 3–5 business days from the time we have all required documents.
This is a service, not a physical product. No goods will be shipped. The report is delivered electronically to the email address you provide.
3. No guarantee of outcome
AutoACV does not guarantee any specific settlement amount, any increase over the insurer's offer, that your carrier will accept the appraisal, or any particular result from invoking the appraisal clause. You are purchasing the professional opinion and the report itself — not a financial outcome. Past results shown on our website are not promises of future results.
4. Refund Policy — please read carefully
Because this is a professional service that begins as soon as an appraiser is assigned, our refund policy is limited:
- 24-hour cool-off: You may request a full refund for any reason within 24 hours of payment, provided the appraiser has not yet started work on your file.
- Once work has started: All fees are non-refundable. "Work has started" means an appraiser has been assigned and has begun reviewing your documents, performing comparable research, or drafting the report.
- After delivery: Once the report has been delivered to your email, the service is complete and fees are non-refundable, regardless of whether you, your attorney, or your insurer agrees with its conclusions.
- Service failure: If we fail to deliver a report within 10 business days of receiving all required documents and have not communicated a delay, you are entitled to a full refund.
To request a refund, email info@autoacv.com from the same address used at checkout. We respond within one business day.
5. Chargebacks and dispute resolution
If you have any concern about your order, you agree to contact us first at info@autoacv.com and give us a reasonable opportunity to resolve it before initiating a chargeback or payment dispute with your bank or card issuer. You expressly agree not to dispute charges for any reason already addressed by this agreement (including outcome dissatisfaction, refund timing within the policy above, or your insurer's response to the report). Filing a chargeback for a service you received, downloaded, or used is considered a breach of this agreement and we reserve the right to:
- Submit full evidence to your card issuer, including this agreement, your IP address, browser fingerprint, your uploaded documents, delivery logs (timestamp + IP of report download), and all correspondence;
- Charge a $50 chargeback handling fee in addition to recovering the disputed amount and any bank fees;
- Recover the disputed amount, chargeback fees, and reasonable collection costs;
- Refuse future service and report uncollected balances to a collections agency.
6. Your responsibilities and warranties
- You confirm that you are the vehicle owner or are authorized to order this appraisal on the owner's behalf.
- You warrant that all documents, photos, vehicle details, mileage, condition notes, and statements you upload or provide are true, accurate, and complete to the best of your knowledge. Material misrepresentation voids any refund eligibility and may invalidate the report.
- You confirm that all uploaded documents are lawfully yours to share.
- You acknowledge that the appraisal report is advisory: you (and not AutoACV) are solely responsible for negotiating with your insurer, deciding whether to accept any offer, invoking the appraisal clause, and engaging legal counsel if needed.
- You will not use our report to commit insurance fraud or misrepresent the condition or ownership of a vehicle.
7. Limitation of liability
To the maximum extent permitted by law, AutoACV's total liability for any claim arising out of the service is limited to the fees you paid for the specific report at issue. We are not liable for indirect, incidental, consequential, or punitive damages, including lost settlement value, attorneys' fees, or carrier delays.
8. Governing law
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Any dispute that cannot be resolved through good-faith communication shall be resolved by binding arbitration in Delaware under the rules of the American Arbitration Association, except that either party may bring a claim in small-claims court if eligible.
9. Changes
We may update these Terms. The version in effect for your order is the version displayed at checkout and recorded with your order (see "Version" at the top of this page).
